When the Secretary of the Army files a court petition to take land for a river or harbor project Congress approved, the United States may take immediate possession and use the land for the authorized work. Before taking possession, the government must make sure fair payment will be available to the owner, either with money already set aside or by depositing funds or other court‑approved security. Owners can ask the court to change the amount or security, and the court must protect them. The government must move the case quickly so compensation is decided and paid promptly.
