Title 33 › Chapter CHAPTER 1— - NAVIGABLE WATERS GENERALLY › Subchapter SUBCHAPTER II— - WATERS DECLARED NONNAVIGABLE: CHANGE OF NAME › § 59h
Makes a specific strip of San Francisco’s waterfront not count as navigable waters of the United States. The area is the landward side of the federal pierhead line near Earl Street, around Pier 30–32, and up to the Van Ness Avenue right‑of‑way. That rule only covers parts that are or will be protected by seawalls (bulkheaded), filled in, or built over with permanent structures. It does not change other federal laws about filling or regulated activities in that area, including sections 401 and 403 of this title, section 1344 of this title, and the National Environmental Policy Act of 1969 [42 U.S.C. 4321 et seq.]. Congress also says the area includes the Embarcadero Historic District’s seawall, piers, and wharves, which were listed on the National Register of Historic Places on May 12, 2006.
