Title 33 › Chapter CHAPTER 1— - NAVIGABLE WATERS GENERALLY › Subchapter SUBCHAPTER II— - WATERS DECLARED NONNAVIGABLE: CHANGE OF NAME › § 59k
Allows filling in or building permanent pile-supported structures along a part of the South Prong of the Wicomico River in Salisbury, Maryland, if the Secretary of the Army, through the Chief of Engineers, finds the project is in the public interest after engineering studies (about bulkheads, fills, and pile stability) and environmental studies under the National Environmental Policy Act of 1969. The area covered runs from the west side of U.S. Route 13 to the west side of the Mill Street Bridge and is bounded on the north and south by lines five feet landward from the current high-tide water’s edge along that reach. The permission applies only to parts that are bulkheaded and filled or have permanent pile-supported structures. Plans must be approved by the Secretary of the Army through the Chief of Engineers. The work must not reduce the river to less than 60 feet wide, and a minimum depth of 5 feet must be kept within that 60-foot width. Local interests must repay the Federal Government for engineering and other costs.
