Allows the Secretary of the Army, acting through the Chief of Engineers, to declare certain parts of the Hackensack River in Hudson County, New Jersey nonnavigable and to allow filling and building permanent pile-supported structures there when the project is found to be in the public interest. That decision must be based on engineering studies about bulkheading, filling, and structural stability to protect the rest of the navigable river, and on environmental studies done under the National Environmental Policy Act of 1969. Congress gives permission for filling and building in the described area, which contains 67.6 acres. The declaration only applies to parts of that area that are already bulkheaded and filled or that already have permanent pile-supported structures. Plans for bulkheading, filling, and permanent pile-supported structures must be approved by the Secretary through the Chief of Engineers. Local interests must repay the federal government for engineering and other costs the government spends under this rule.
