The Secretary of the Army (through the Chief of Engineers) must carry out river and harbor improvement work in the most economical and useful way. Dredging and related jobs should be done by private companies when they can do the work at reasonable prices and on time. For four years starting April 26, 1978, the Secretary may limit this rule when the federally owned dredge fleet is available so the change to private contractors happens in an orderly way. As private industry proves it can do the work, the federal fleet must be reduced by retiring equipment. The Secretary must keep only the smallest federal fleet needed for emergency and national defense work, but may keep more if needed so the government and private industry together can meet project needs. The federal fleet kept must be modern and replaced when needed. The Secretary must study and report to Congress within two years after April 26, 1978, to decide the minimum fleet and to address employee rights. The Secretary must start a program to use more private hopper dredges for navigation channels. The federal hopper dredge Wheeler must be put in ready reserve by the earlier of 90 days after rehab of the McFarland under section 563 of the Water Resources Development Act of 1996 or October 1, 1997. The Wheeler can be tested and repaired while in ready reserve but cannot be given scheduled work unless private industry fails to bid or perform. The Secretary must set up procedures to keep private dredge capacity for routine and urgent needs, report to Congress within two years after October 12, 1996, about the Wheeler’s status, limit reductions in readiness, limit how much work a federal hopper can be assigned (with exceptions for the Essayons and Yaquina), keep Pacific and Atlantic coast availability at 1996 levels, and may contract maintenance and crewing. Capital costs for ready-reserve dredges come from the Harbor Maintenance Trust Fund.
