Title 33 › Chapter CHAPTER 15— - FLOOD CONTROL › § 702j–2
The Chief of Engineers, under the Secretary of the Army, must build a system of levees paid for by the United States. The work should follow the plan shown on map sheet numbered 1 from the report dated April 2, 1925, filed in the offices of the First and Second Mississippi River Commission Districts in Memphis, Tennessee. The Chief may change grades and levee sections. Work cannot start until the State, levee boards, or other local groups give promises acceptable to the Secretary that they will provide, at no cost to the United States, the needed rights-of-way, any drainage made necessary by the levees, and any flowage or storage rights/easements if the area is used as an emergency reservoir, and that they will protect the United States from liability for damages during such use.
