Title 33 › Chapter CHAPTER 15— - FLOOD CONTROL › § 707
Sumner Dam and Lake Sumner on the Pecos River in New Mexico must be used to control floods, manage river flow, store and deliver water, reclaim land, and other useful purposes. Water use has a priority: first for irrigation, second for flood control and river management, and third for other uses. The Chief of Engineers and the Secretary of the Army must report to Congress how much of the dam’s total cost is properly for flood control. The law allows that amount to be moved from the Treasury’s general fund into the reclamation fund to reduce the Carlsbad Irrigation District’s maximum repayment obligation.
