Within one year after December 19, 2002, the Secretary must create the Hydrographic Services Review Panel. The panel must advise the Administrator on issues tied to hydrographic duties in section 892a and other topics the Administrator sends for review. The Administrator must give the panel any needed information, staff help, and administrative support. The panel will have 15 voting members chosen by the Administrator. The Co‑directors of the Center for Coastal and Ocean Mapping/Joint Hydrographic Center and up to 2 NOAA employees may join as nonvoting members. Voting members must be experts in fields related to hydrographic data and services, marine transportation, port or coastal management, or similar areas. Full‑time U.S. federal employees cannot be voting members. If a voting member is seeking or getting assistance under this subchapter, they must tell the panel and not vote on that matter. Voting members serve four‑year terms. At the start, five are appointed for 2 years, five for 3 years, and five for 4 years. A member may be reappointed once for a full term and may stay until a successor takes office. Each year the Secretary must ask for nominations in the Federal Register. The panel picks a Chair and a Vice Chair, and the Vice Chair fills in when needed. Voting members can be paid up to the daily rate in 5 U.S.C. 5376 when working for the panel and must be reimbursed for reasonable expenses. The panel meets twice a year and can meet more if the Chair, a majority of voting members, or the Secretary asks. The panel may use powers needed to do its job.
