Divide the grant money into two main pieces. Eighty-five percent goes to one group of eligible States and territories, and fifteen percent goes to another group. For the 85% group, each eligible State gets 0.75% up front, while the U.S. Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands get 0.05% each (if they qualify). After that, the rest is split among the eligible States based on how many Part 1 violent crimes each State reported to the FBI in the three years before the decision, compared to the average for those States. No State can get more than 9% of that 85% pool. For the 15% group, each eligible State gets 3.0% up front, the same four territories get 0.03% each (if they qualify), and the remaining money is split by the same three-year violent-crime ratio for that group. For a separate set of grants, money is divided among eligible States by the same three-year average of Part 1 violent crimes, but no State may receive more than 25% of that pool. If a State’s three-year crime data is missing or clearly wrong, the Attorney General must use the best comparable data available for the previous year. States that are in a regional compact are treated by first calculating each member State’s share and then adding those amounts together for the compact.
