Circuit judicial councils are encouraged to study whether gender bias exists in their federal courts and to make changes if needed. The studies may look at 12 topics, including how litigants, witnesses, attorneys, jurors, and judges are treated; how laws are applied in civil and criminal cases; treatment of defendants and victims; sentencing and supervision of probation or parole; appointments to committees and hiring or promotion of court employees; case management and court-run dispute programs; appointment of arbitrators, experts, and special masters; rules about using a victim’s past sexual history; and other court-related issues mentioned in section 12372. The Administrative Office of the United States Courts must collect and share the task forces’ reports and respond to requests for them. The Federal Judicial Center must include these court-related topics in its education and training programs (including training for new judges) under section 620(b)(3) of title 28 and must prepare the needed training materials.
