Each appropriate agency must create a regular review process to check that covered housing programs follow rules protecting people who are survivors of domestic violence, dating violence, sexual assault, or stalking. Agencies should fold these checks into other reviews when they can and work with the Gender-based Violence Prevention Office, the Violence Against Women Act Director, and other officials. Reviews must look at six things: whether help, tenancy, or occupancy was denied because someone was a survivor; whether confidentiality rules were followed; whether required notices were given; how documentation was accepted; whether emergency transfer rules were followed; and whether anyone faced retaliation. Not later than 2 years after March 15, 2022, each agency must issue regulations under section 553 of title 5 to put the review process in place. The regulations must set compliance standards, require detailed reports (including how many emergency transfers were requested and granted and how long they took), and set rules for corrective action plans. Agencies must consult experts on survivors’ housing needs and housing program administrators when writing the rules. Each agency must also prepare an assessment of the review findings that covers the topics above and make that assessment public.
