The Attorney General must collect yearly data, under section 534 of title 28, about crimes that show prejudice because of race, gender or gender identity, religion, disability, sexual orientation, or ethnicity. The data should cover, when appropriate, crimes such as murder, non-negligent manslaughter, forcible rape, aggravated and simple assault, intimidation, arson, and destruction, damage, or vandalism of property. The Attorney General must create rules for how to collect the data, what evidence is needed to find bias, and how to carry out the work. The law says “sexual orientation” means consensual homosexuality or heterosexuality. The data can only be used for research or statistics and must not reveal a victim’s identity. The Attorney General must publish an annual summary, including crimes by and against juveniles. This law does not create a new right to sue, including over sexual-orientation discrimination, and it does not limit existing rights to sue under laws like the Administrative Procedure Act or the All Writs Act. Funds may be provided as needed to carry out this law through fiscal year 2002.
