Title 35 › Part PART II— - PATENTABILITY OF INVENTIONS AND GRANT OF PATENTS › Chapter CHAPTER 11— - APPLICATION FOR PATENT › § 118
Someone who has been assigned an invention, or must later be assigned it, can apply for a patent. A person with a real ownership interest can apply as the inventor’s agent if they prove the facts and show the filing protects the parties’ rights. If the Director grants the patent to someone other than the inventor, the patent is given to the real owner and the inventor is notified in the way the Director finds sufficient.
