Small businesses, nonprofit organizations, and their assignees who own an invention made with federal funds may not give anyone exclusive U.S. rights to the invention unless that person agrees the products will be made mostly in the United States. The federal agency that funded the work can waive this rule if the owner shows they tried and failed to find licensees who would manufacture in the U.S. or if U.S. manufacture is not commercially feasible.
