Title 35 › Part PART I— - UNITED STATES PATENT AND TRADEMARK OFFICE › Chapter CHAPTER 2— - PROCEEDINGS IN THE PATENT AND TRADEMARK OFFICE › § 24
On a party’s request, a federal court clerk there must issue a subpoena to make a witness testify in a contested Patent and Trademark Office case. Federal civil procedure rules apply. Witnesses get the same fees and travel pay as in U.S. district courts. Judges may enforce subpoenas and punish refusal. No punishment for refusing unless fees, travel, and one day's attendance are paid or offered when served. Witnesses may refuse to disclose secrets unless the issuing court orders otherwise.
