Title 37 › Chapter CHAPTER 10— - PAYMENTS TO MISSING PERSONS › § 557
The Secretary, or someone they pick, can settle the pay records of a service member who got payments under sections 552, 553, and 555, and can settle accounts for survivors if a casualty to a ship, station, or base destroys disbursing records. Payments or settlements made because someone was reported dead cannot be reopened just because a later report fixes the date of death. If the later date is after the one used before, the account must be reopened and settled with that later date. A disbursing officer, or a civilian or service member who authorized a payment, cannot be made to repay an innocent mistake if there was no fraud or crime, except under section 558.
