State rules that presume someone dead don’t apply to benefit claims the Secretary handles. If the Secretary gets evidence that a person has been missing from home and family for seven or more years and a diligent search finds no proof they were alive after disappearing, the Secretary will treat that person as dead from then; that finding is final except under a lawsuit brought under section 1984.
