Veterans who served on active duty in the Southwest Asia theater during the Persian Gulf War can have certain illnesses treated as caused by their service for benefits under section 1110, subject to section 1113. The Secretary must create rules that list diagnosed or undiagnosed illnesses that are linked to exposure to biological, chemical, or other toxic agents, environmental or wartime hazards, or preventive medicines or vaccines tied to that service. The illness must appear within the time period set in those rules for a veteran who was exposed while serving. A veteran with one of those illnesses is presumed to have been exposed because of that service unless there is conclusive evidence they were not exposed. Signs or symptoms that might show an undiagnosed illness include the ones listed in section 1117(g). Any decision made on or after the date of enactment of the Sergeant First Class Heath Robinson Honoring our Promise to Address Comprehensive Toxics Act of 2022 must follow subchapter VII of this chapter.
