The VA must treat certain veterans as having been exposed to listed toxic substances, chemicals, or airborne hazards when they apply for disability or related benefits, unless there is clear proof they were not exposed. When a veteran files a claim with evidence of a disability and a possible toxic exposure during active service, the VA may look at any exposure tracking records it has. If those records do not show exposure, the VA will look at all the facts of the veteran’s service to decide the claim. The VA must make and keep a list of the substances and hazards with help from the Department of Defense. The VA must use required evaluation steps to decide if there should be an end date for who gets the presumption, but any end date cannot be earlier than the last day of the Persian Gulf War period. The VA must report to the House and Senate Veterans’ Affairs Committees no later than two years after the Sergeant First Class Heath Robinson Honoring our Promise to Address Comprehensive Toxics Act of 2022 was passed, and at least every two years after that, listing any additions or removals from the list. Covered veteran — a short label for veterans who served on or after August 2, 1990 in duty stations (including the airspace above them) in Bahrain, Iraq, Kuwait, Oman, Qatar, Saudi Arabia, Somalia, or the United Arab Emirates, or who served on or after September 11, 2001 in duty stations (including airspace) in Afghanistan, Djibouti, Egypt, Jordan, Lebanon, Syria, Yemen, Uzbekistan, or any other country the Secretary says is relevant. Exposure tracking record system — any VA or DoD system that tracks service exposures, including the Individual Longitudinal Exposure Record. Toxic exposure risk activity — the meaning given in section 1710(e)(4).
