The Secretary must give certain former service members an initial mental health check and any mental or behavioral health care they need, including help for suicidal thoughts or risk of harming others. Eligible people are former members (including reserves) who were discharged under a condition that is not honorable but not dishonorable or by court-martial, who are not enrolled in the VA health system under section 1705, and who either served more than 100 cumulative days and were deployed to a combat or contingency area (including controlling an unmanned aircraft from elsewhere during hostilities) or were victims of sexual assault, sexual battery, or sexual harassment while serving. Care can be given at non-VA facilities if a VA mental health professional says VA care would be clinically inappropriate or if VA care is not practical because of distance, and the Secretary may use contract authorities (such as section 1703) to do this. The Secretary must try to place care in the most appropriate therapeutic setting and must help people who are not eligible find care outside the Department. The Secretary must tell each eligible person about this care no later than the later of 180 days after the Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2018 was enacted or 180 days after discharge, provide a toll-free number, keep information updated and posted at VA facilities and to state veteran agencies, and coordinate with the Secretary of Defense about separation information. Each year by February 15, the Secretary must report to the Senate and House Veterans’ Affairs Committees with numbers and details about who got care, who asked for assessments, types of needs treated, demographics (age, era, branch, location), average visits per person, and other relevant information.
