Title 38 › Part PART II— - GENERAL BENEFITS › Chapter CHAPTER 19— - INSURANCE › Subchapter SUBCHAPTER II— - UNITED STATES GOVERNMENT LIFE INSURANCE › § 1947
Subject to section 1954, insurance contracts are final from the date they are issued, reinstated, or converted and cannot be challenged except for fraud, nonpayment of premiums, or if the applicant was not a U.S. service member. The insured may file a claim with the Department or sue under section 1984 for an earlier policy and, if entitled, surrender a later policy to get payments under the earlier one. If a policy is voided for fraud after March 16, 1954, the Secretary must refund premiums paid for any period after two years from the date the fraud led to issuance, reinstatement, or conversion, minus dividends, loans, or other payments, with no interest. The refund goes to the living insured, the named beneficiary, or the estate.
