Policies bought under section 1966 must first set basic premium rates by age for the first policy year. The Secretary must set those age rates so they match the lowest rates usually charged for new group life policies to large employers. Those age rates are used to work out an average basic premium per $1,000 of insurance. The same basic rates stay in later years unless the insurance company reads them again based on the policy’s experience, using a method the Secretary approves that matches common industry practice. Total premiums equal that average premium plus an extra amount to cover the higher risk of active duty. The Secretary decides that extra amount and it is adjusted retroactively each year under section 1969(b). If finding the real age mix is too costly, the Secretary can allow a tentative average premium instead, and that tentative rate can be changed during the year if it proves wrong when the insurer asks. Each policy must also set a maximum expense and risk charge for the first year, set by the Secretary to match usual group life charges for large employers. Those maximums continue but the Secretary can change them by agreement or after giving one year’s written notice. The insurer must give the Secretary an accounting within 90 days after each policy year showing premiums earned, total claims, and expense and risk charges. Any extra money (premiums minus claims and charges) goes into a special contingency reserve for that policy and earns interest at a rate the insurer sets in advance and the Secretary approves. Once the Secretary finds the reserve is large enough, further excesses go to the revolving fund under section 1969(d)(1). If the policy ends and money remains, it also goes to that revolving fund, but the insurer may pay that deposit in equal monthly installments over up to two years.
