Title 38 › Part PART II— - GENERAL BENEFITS › Chapter CHAPTER 24— - NATIONAL CEMETERIES AND MEMORIALS › § 2405
The Secretary may transfer inactive cemeteries, burial plots, memorials, or monuments under the Secretary's control to the Department of the Interior to be kept as part of the National Park System, or to another federal agency; money appropriated for the Park System can be used to manage those sites. The Secretary may also give full ownership of such cemeteries or parts of them to a State, county, city, or their agency, but if the new owner stops caring for the site in a way the Secretary finds acceptable, ownership goes back to the United States. The Secretary may move remains from a discontinued cemetery, a temporary burial, or an abandoned grave into a national cemetery run by the National Cemetery Administration.
