Title 38 › Part PART III— - READJUSTMENT AND RELATED BENEFITS › Chapter CHAPTER 30— - ALL-VOLUNTEER FORCE EDUCATIONAL ASSISTANCE PROGRAM › Subchapter SUBCHAPTER IV— - TIME LIMITATION FOR USE OF ELIGIBILITY AND ENTITLEMENT; GENERAL AND ADMINISTRATIVE PROVISIONS › § 3033
You cannot get education benefits from more than one program at the same time. That rule covers chapters 31, 32, 33, and 35; title 10 chapters 106 and 107; and the Hostage Relief Act of 1980. If you qualify for more than one, you must pick which program will pay and use the form the Secretary requires. Those under chapter 34 may not use this chapter’s benefits before January 1, 1990. Time used to repay a loan under title 10 chapter 109 cannot also count toward benefits here. Service in the Selected Reserve may be credited to only one of this chapter, chapter 33, or title 10 chapters 1606 and 1607; you must choose which program gets the credit.
