Each State’s top official (like the governor) must set up or name a State department or agency to serve as the State approving agency for this law and for chapters 34 and 35, unless state law already says something different. If a State does not do this or does not enter into an agreement under section 3674(a), or when courses are approved by the Secretary under section 3672, the term “State approving agency” means the Secretary. The Secretary cannot accept an agency as the State approving agency if that agency is run at, or located with, a university or university system that offers programs the agency would approve.
