A member of the Armed Forces who is enrolled in college and then gets orders to start military duty may withdraw or take a leave from their studies. The college must not punish the student for doing this. That means the school cannot give a failing grade, lower the student’s GPA, call the absence unexcused, or charge a financial penalty because the student left for duty. If the student withdraws, the college must refund all tuition and fees for that academic term, including housing. If the student takes a leave, the college must give an “incomplete” (or similar) grade for the term and, when possible, let the student finish the term after the duty ends. Covered education means college courses paid with education benefits the Secretary manages. Covered member means a member of the Armed Forces enrolled in covered education. Covered service means active duty, inactive-duty training, or State active duty. Institution concerned means the college where the member is enrolled. Institution of higher education has the meaning in the Higher Education Act. Period of covered service means from the start of the duty orders until release from duty or death while serving.
