The Secretary may make direct home loans to Native American veterans who live on trust land if certain rules are followed. The veteran must have a real ownership interest in a lot or home on trust land and must use the loan to buy, build, or fix a home there. The veteran must give that interest to the Secretary as loan security. The Secretary and staff may enter the land to check the loan, watch construction or repairs, and manage or inspect property after foreclosure. The program must have clear foreclosure and resale steps, written lending and underwriting rules, appraisals and value checks, and minimum planning and construction standards. Loans must be made carefully to protect the United States’ financial interests. Loans are paid back in monthly payments. The Secretary can advance money for repairs and charge the veteran reasonable loan origination costs. The Secretary can work with tribes, other groups, or federal agencies and can stop making new loans in an area if partners fail to follow the rules. Interest rates are set by the Secretary but may not exceed the rate allowed for similar guaranteed loans under sections 3703(c)(1) or 3712(f). The Secretary can make rules, manage loan assets, hire help, and require appraisals that generally follow section 3731 unless impractical. The Secretary may also refinance loans under specific conditions (including a required 1 percentage point rate drop for some refinances, limits tied to the home’s reasonable value, and rules for repairs or energy improvements). The Secretary must run an outreach program with tribal groups, report yearly on loan costs and numbers, and assign enough staff, including construction and appraisal specialists.
