The Secretary may recognize people from the American National Red Cross, the American Legion, Disabled American Veterans, United Spanish War Veterans, Veterans of Foreign Wars, and other approved groups to help prepare, present, and pursue claims under the laws the Secretary administers. The Secretary may also, when space is available, provide office space for paid, full‑time representatives of these national groups. A recognized individual must certify they will not charge any fee for claim help and must file a power of attorney in the form the Secretary requires. Such individuals are subject to the rules in section 5904(b) the same as those under 5904(a). If a claimant names an organization, one of its offices, or a recognized representative without saying they want only that person, the Secretary can treat the whole organization as the claimant’s representative and must send notices to the address the organization gives. Retired officers, warrant officers, and enlisted members who help with claims while not on active duty do not violate sections 203, 205, 206, or 207 of title 18.
