People put in charge of money or property for a minor, someone who cannot manage their own affairs, or another beneficiary under the Secretary’s programs must not loan, borrow, pledge, use, trade, or otherwise take that money or property unless the law allows it. If they do, they can be fined under Title 18, jailed for up to five years, or both. Willfully refusing to file required accountings or reports is treated as enough proof of stealing or misusing the funds.
