Title 38 › Part PART IV— - GENERAL ADMINISTRATIVE PROVISIONS › Chapter CHAPTER 61— - PENAL AND FORFEITURE PROVISIONS › § 6104

Last updated Apr 6, 2026|Official source

Summary

If the Secretary finds someone guilty of mutiny, treason, sabotage, or helping an enemy of the United States or its allies, that person loses all current and future benefits the Secretary manages. The Secretary may choose to give some of those lost benefits to the person's dependents, but no dependent can get more than they would if the person had died. After September 1, 1959, the Secretary cannot make those apportionments or award benefits for any service period that began before the offense.
