§6105 Forfeiture for subversive activities

Title 38 › Part PART IV— - GENERAL ADMINISTRATIVE PROVISIONS › Chapter CHAPTER 61— - PENAL AND FORFEITURE PROVISIONS › § 6105

Last updated Apr 6, 2026|Official source

Summary

A person convicted after September 1, 1959 of certain listed offenses loses free benefits the Secretary administers that are based on military, naval, air, or space service done before the offense. The loss starts on the date of the offense and also prevents anyone else from getting those benefits because of that person. If an indictment is returned, the Secretary must suspend benefit payments until the criminal case is finished. A presidential pardon restores the benefits from the date of the pardon. The covered offenses include title 10 sections 894, 904, and 906; a set of specific Title 18 sections and chapter 105; sections 222–226 of the Atomic Energy Act; and section 4 of the Internal Security Act of 1950. The Secretary of Defense or the Secretary of Homeland Security must notify the Secretary about military convictions, and the Attorney General must notify the Secretary about indictments or convictions under the other listed laws.
