An officer in charge must store any unclaimed property found on Department premises. If no one claims it within 90 days, the officer may sell, use, destroy, or otherwise dispose of it under rules set by the Secretary. If it is not disposed, the owner, personal representative, or next of kin can reclaim it by paying reasonable storage charges. If the property is sold, the net money goes into the post fund. The person entitled, or that person’s legal representative or assignee, can be paid the proceeds minus expenses if they claim it within five years of the find. If the owner died without a will and left no creditors or next of kin, the legal representative cannot receive the proceeds.
