Anyone claiming a right to a deceased veteran’s personal property can file a claim with the Secretary within five years after the veteran’s death, even if the assets were already put into the Fund. If the claimant proves under the laws of the veteran’s home state that they were entitled to the property at the time of death, the Secretary may pay them from the Fund up to the net amount credited from that decedent’s estate, minus necessary expenses, or deliver any remaining assets themselves to the lawful owners. If a person entitled was under legal disability at the veteran’s death, the five-year time limit starts when that disability ends. If ownership is uncertain, the Secretary may start court proceedings. A court decision does not bind the United States or the Secretary unless the Secretary was properly notified and given 30 days to ask to join; notice can be in person or by registered or certified mail to the Secretary or the Secretary’s authorized attorney. The Secretary may waive notice, and court costs may be paid if authorized.
