Title 40 › Subtitle SUBTITLE II— - PUBLIC BUILDINGS AND WORKS › Part PART A— - GENERAL › Chapter CHAPTER 31— - GENERAL › Subchapter SUBCHAPTER II— - ACQUIRING LAND › § 3112
The federal government does not have to take full legal control of land it acquires. A department, agency, or other federal official can choose to accept a State’s agreement to give or transfer jurisdiction over land they control. To accept, the official must file a notice with the State’s Governor or follow whatever method State law requires. Until that is done, it is legally treated as not having accepted jurisdiction.
