Violating or trying to violate 5104(e)(1) can lead to a federal fine, up to five years in prison, or both. Violating or trying to violate 5103 or certain parts of 5104 (subsections b, c, d, e(2), or f) can lead to a federal fine, up to six months in jail, or both. The Attorney General must bring prosecutions for violations of this chapter and for sections 9, 9A, 9B, 9C, and 14 of the July 31, 1946 Act. If the same conduct breaks other federal or D.C. laws, those charges can be joined. Cases for 5104(e)(1) or felony conduct go to the U.S. District Court for D.C.; the other listed cases go to the D.C. Superior Court. If multiple laws are broken, the defendant faces the highest penalty allowed.
