Federal agencies must make companies give true cost or pricing data when they want large contracts, big contract changes, or big subcontracts. For prime contracts awarded other than by sealed bid, a company must give those data before award if the contract is expected to cost the government more than $2,000,000 for contracts after June 30, 2018, or more than $750,000 for contracts entered on or before June 30, 2018. Companies must also give data before pricing a change if the expected price adjustment is over $2,000,000 in some cases or over $750,000 in others. Subcontractors must give data when the prime and higher-tier subcontractors were already required to do so and the subcontract exceeds the dollar thresholds set for those situations. Anyone required to send cost or pricing data must also certify that the data are accurate, complete, and current. Prime contractors send their data to the contracting officer or the officer’s representative. Subcontractors send theirs to the prime contractor. A waiver for a contract does not automatically waive the need for data from its subcontracts unless the agency head writes a separate justification. Agencies must update the dollar amounts every five years on October 1, as directed by law.
