Creates a Monitored Retrievable Storage Review Commission made up of 3 people chosen by the President pro tempore of the Senate and the Speaker of the House. The members must be named within 30 days after December 22, 1987, and must be highly qualified by training and experience to study whether a monitored retrievable storage (MRS) facility should be part of the national plan for handling spent nuclear fuel. The commission must review the Secretary’s analysis, get comments and data from affected parties (including States with possible sites), study the technical usefulness of an MRS, and recommend to Congress whether an MRS should be included to help with packaging and handling of spent fuel, make repository scheduling more flexible, and provide temporary storage of fuel accepted for disposal. The commission must compare an MRS with keeping fuel at reactors before final disposal, looking at effects on repository design and construction, waste package design and standardization, waste preparation, transportation systems, overall reliability of the disposal system, the Secretary’s ability to meet contracts to accept fuel, and economic effects on electric utility ratepayers for both temporary at-reactor storage and building/operating an MRS. The report and recommendation must go to Congress on November 1, 1989. Members are paid at the Executive Schedule level III daily rate and receive travel pay; staff pay may not exceed GS–18. The commission can hold hearings, take evidence, swear in witnesses, get help and records from executive agencies (unless forbidden by law), use GSA services for a fee, and hire temporary experts. The commission ends 60 days after it sends the report to Congress.
