A chosen site under section 10165 becomes final after 60 calendar days from the date people are told about it, unless the tribe’s governing body (if the site is on a reservation) or the State’s governor and legislature (if the site is off a reservation) sends Congress a notice saying they disapprove. If such a notice is sent, the site choice does not take effect except as allowed by section 10135(c). When applying these rules, any mention in section 10135(c) of a “repository” means a monitored retrievable storage facility, and any mention in sections 10136(b) or 10138(a) of a notice of disapproval of a repository site means the same kind of notice under this rule.
