Title 42 › Chapter CHAPTER 108— - NUCLEAR WASTE POLICY › Subchapter SUBCHAPTER III— - OTHER PROVISIONS RELATING TO RADIOACTIVE WASTE › § 10225
The Secretary must send Congress a report within one year after January 7, 1983, saying whether the test and evaluation facility will be placed at a repository site. If the facility is planned for any candidate or repository site, its site choice and development must follow the same site-selection and development rules used for repositories. The Secretary cannot start building any surface parts of that facility until the Commission has given a construction authorization for a repository at that site. The facility cannot be turned into a repository unless it was chosen and developed under those same repository rules. The Secretary also may not begin building at a candidate or recommended repository site until the site’s designation is effective under section 10135 of this title.
