Defines key words used in this subchapter. Abuse means a staff member at a care facility did something, or didn’t do something, on purpose or recklessly that caused or could cause harm or death to a person with mental illness; examples include sexual assault, hitting, using too much force to put on restraints, or using restraints in ways that break federal or state rules. Eligible system means the state program set up under subtitle C of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 to protect and speak up for people with developmental disabilities. Facilities may include hospitals, nursing homes, community mental health centers, group homes or board-and-care homes, homeless shelters, jails, and prisons. Individual with mental illness means a person a qualified mental health professional finds has a serious mental illness or emotional problem and who is either in or being taken to a care facility (including inpatients, people being admitted or transported, and those involuntarily held in local detention not as a criminal sentence) or who meets that test and lives in the community, including their own home (except as provided in section 10804(d)). Neglect means a caregiver’s careless act or failure that causes or risks harm or death to a person with mental illness, such as not making or following a treatment plan, not providing enough food, clothing, or health care, not keeping the place safe, or not having enough trained staff. Secretary means the Secretary of Health and Human Services. State means each State, the District of Columbia, Puerto Rico, Guam, the Commonwealth of the Northern Mariana Islands, American Samoa, the Virgin Islands, and the Trust Territory of the Pacific Islands. American Indian consortium means a consortium set up under part C of the Developmental Disabilities Assistance and Bill of Rights Act (42 U.S.C. 6042 et seq.).
