Money recovered from HUD’s Homeless Assistance Grants can be used until it is spent, but no later than the end of the fifth fiscal year after the last year those funds were available. That recovered money is added to other homeless program funds and must be used for Continuum of Care grants, Emergency Solutions Grants, at least 10% for rural Continuum of Care grants (including certain Rural Housing Stability activities), and at least 10% for Emergency Solutions Grants that help disaster areas. Before spending or awarding these recovered funds, the HUD Secretary must send a plan to the House and Senate Appropriations Committees and get written approval. Money set aside for the 10% disaster emergency grants can start being used once the plan is submitted. The Secretary can give Emergency Solutions Grants to states or local governments for areas hit by a major disaster declared on or after December 20, 2019, if other federal disaster aid (including Transitional Sheltering Assistance) does not meet the need. For those disaster grants, the Secretary may waive consultation, public participation, and matching rules.
