The state's chief executive (for example, the governor) must prepare and send a State plan that covers a 3-year period to the Commissioner to be eligible for grants under sections 12337, 12338, or 12339. The chief executive may update the plan each year. The plan must include the assurances required under those sections and a short description of the state's multi-year plans for developing and running the programs. A State can apply for funds under section 12337 alone, under sections 12337 and 12338 together, or under section 12339. The Commissioner must approve any plan under sections 12337 and 12338 that meets the rules. Before the Commissioner disapproves, changes, or declares a State ineligible for funds under sections 12337 and 12338, the State must get notice and a chance to fix any problems.
