When the Commissioner of Social Security asks a State for information to decide if a person is eligible for benefits or the right amount under subchapter II or XVI, the federal rules for using, protecting, and sharing that information apply. The federal rules, including those the Commissioner creates under section 1306 or any other federal law, count as meeting any State rules that would otherwise limit the State from giving the information.
