Title 42 › Chapter CHAPTER 7— - SOCIAL SECURITY › Subchapter SUBCHAPTER XI— - GENERAL PROVISIONS, PEER REVIEW, AND ADMINISTRATIVE SIMPLIFICATION › Part Part A— - General Provisions › § 1320b–13
The Social Security Commissioner must give a person a social security account statement if the person asks for one, starting no later than October 1, 1990. Each statement must show the person’s recorded wages and self‑employment earnings, estimates of the total Social Security contributions for old‑age, survivors, and disability insurance and a separate estimate for hospital insurance, and estimated monthly retirement, disability, survivor, and auxiliary benefits. It must also describe Medicare benefits. People affected by special rules about pension offsets must get a plain‑language explanation of how those rules could change their monthly benefits. An “eligible individual” means someone who has a Social Security number, is at least 25 years old, and either has reported wages or self‑employment or whose work history suggests some noncovered employment. The Commissioner must tell people the statements exist. By September 30, 1995 the Commissioner must send statements to people who were 60 by October 1, 1994 (and to those who turn 60 in fiscal years 1995–1999) if they are not receiving benefits and a current address can be found. Starting October 1, 1999, annual statements must be sent to all eligible people not receiving benefits and with a reachable address; statements for people under 50 may omit retirement‑amount estimates but must describe available retirement benefits. For public‑sector hires starting on or after January 1, 2005, the hiring agency must give a written, Commissioner‑prescribed notice before work begins explaining how noncovered service and related payments can affect Social Security benefit calculations, and the worker must sign and return a receipt form to the agency and the pension system before starting.
