Title 42 › Chapter CHAPTER 134— - ENERGY POLICY › Subchapter SUBCHAPTER VII— - GLOBAL CLIMATE CHANGE › § 13389

Last updated Apr 6, 2026|Official source

Summary

Creates a federal effort to find, test, and spread technologies and practices that cut the amount of greenhouse gas released for each dollar of economic output. Not later than 180 days after August 8, 2005, the President must set up a Committee on Climate Change Technology. The Committee must have at least 7 members and include the Secretary of Energy (who chairs it), the Secretary of Commerce, the Chairman of the Council on Environmental Quality, the Secretary of Agriculture, the Administrator of the Environmental Protection Agency, the Secretary of Transportation, the Director of the Office of Science and Technology Policy, and any others the President names. Not later than 18 months after August 8, 2005, the Committee must give the Secretary and the President a national strategy to promote commercial use of technologies that reduce greenhouse gas intensity, make that strategy public, and update it at least every 5 years. The Secretary of Energy, working with the Committee, must set up a Climate Change Technology Program within the Department of Energy not later than 180 days after the Committee is formed. The Secretary must inventory current and developing greenhouse gas intensity–reducing technologies, report the results to Congress within 180 days after finishing the inventory, and use the inventory to guide commercialization and deployment. The Secretary may create a Climate Change Technology Advisory Committee to identify barriers to deployment; that Advisory Committee will include representatives from each National Laboratory, trade groups, consumer groups, federal experts, and higher-education experts, must report within 1 year after August 8, 2005 and annually, and give recommendations. Using the strategy, inventory, and advisory reports, the Committee must recommend ways to remove barriers, may propose demonstration projects, and must submit a report and demo plan to the President and Congress not later than 18 months after August 8, 2005 (and update it at least every 5 years). The Secretary, with the Committee and NIST, must set standards for measuring greenhouse gas intensity, may fund demonstration projects (with required cost-sharing), and may enter into cooperative research and development agreements.

section 15801(3) of this title, referred to in subsec. (a)(7), was in the original “section 3(3) of the Energy Policy Act of 2005” and was translated as meaning section 2(3) of that Act to reflect the probable intent of Congress, because the Energy Policy Act of 2005 does not contain a section 3 and section 2(3) defines “National Laboratory”. This subtitle, referred to in subsec. (j), appearing in the original, is unidentifiable because title XVI of Pub. L. 102–486, of which this section is a part, does not contain subtitles.
