Owners of a covered Section 8 housing project that gives priority to elderly families can, if they find under the Secretary’s rules that not enough elderly applicants applied to fill the non-reserved units, give those units to disabled families who are “near-elderly” and have applied. Likewise, if not enough disabled (non-elderly or near-elderly) applicants apply to fill units reserved under section 13612, the owner can give those reserved units to disabled near-elderly applicants.
