People on Medicare can choose any doctor, clinic, or other approved provider who agrees to treat them. A doctor or practitioner may make a private contract with a Medicare patient for services only if the doctor will not bill Medicare, will not get Medicare payment (directly or through a capitation plan), and will not get paid for those services by an organization that does get Medicare money for them. The contract must be written, signed by the patient before care starts, cannot be used in an emergency, and must plainly tell the patient that they agree not to bill Medicare, will pay themselves, understand Medicare rules do not limit what can be charged, know that Medigap or other supplemental plans may not pay, and know they can still seek care from providers who accept Medicare. The doctor must sign and file an affidavit saying they will not bill Medicare for a 2-year period and must file a copy with the Secretary within 10 days after the first private contract. The 2-year period starts when the affidavit is signed and continues unless the doctor tells the Secretary at least 30 days before the period ends that they do not want to extend it. If the doctor knowingly bills Medicare or gets payment during the period, the opt-out rules stop and no Medicare payments will be made for services during that time. Starting February 1, 2016, HHS must publish and update at least yearly information about opt-out providers (number, specialty, location, timing of opt-out, and how many billed for emergency/urgent care). Medicare beneficiary — someone entitled to Part A or enrolled in Part B. Physician — the kinds of doctors listed in the statute. Practitioner — other health professionals defined in the statute. Opt-out physician or practitioner — a provider who has a signed affidavit in effect.
