Sets how monthly Medicare Part D premiums are figured and what can change them. The base premium is a percentage (using 25.5% now, or a later percent for 2030 and after) times the national average monthly bid. If a plan’s bid is higher or lower than the adjusted national average, the base premium goes up or down by that difference. The premium is also raised by the part of a plan’s approved bid that pays for extra (supplemental) drug benefits, and by any late‑enrollment penalty. It can be reduced for people who qualify for a subsidy. For 2024–2029 the base premium is capped each year at the lesser of a 6% increase over the prior year or the full computed amount; normal rules return in 2030. The premium is the same for all enrollees in a plan’s region except for the late‑enrollment penalty, subsidy reductions, and income‑related increases. Adds a penalty when someone delays enrolling. If, after your first chance to join, you go 63 days or more without "creditable" drug coverage, you may pay a late‑enrollment amount. That penalty is either an actuarially sound amount the government sets or 1% of the base premium for each month you were uncovered—whichever is larger. Creditable coverage includes things like other Medicare drug plans, Medicaid, employer plans, certain state or veterans’ drug programs, and similar coverage that the Secretary approves. People eligible for the Part D subsidy never pay the penalty. The Social Security Commissioner figures and collects income‑related premium increases, and the Secretary and Commissioner must share yearly premium and income information (with specific September 15 and October 15 disclosure dates) so those income‑based adjustments can be applied and collected from benefits if needed.
