Requires that collecting, storing, or moving used rechargeable batteries, certain other batteries, and consumer products with batteries that cannot be easily removed must follow the EPA rules published at 60 Fed. Reg. 25492 (May 11, 1995) as they were on May 11, 1995, even if a state or local law says something different. Two exceptions: the rules in 40 CFR 260.20, 260.40, and 260.41 do not apply, and lead‑acid batteries covered by 40 CFR 266 subpart G (or an equivalent state program) are not covered. People who ignore these duties can be enforced under the Solid Waste Disposal Act (42 U.S.C. 6901 et seq.). A state may run and enforce these same rules if the EPA Administrator finds the state’s rules are identical and the state provides for enforcement.
