The Administrator can allow a new use of a battery technology or the use of a battery in a new product to be exempt from the rules in this subchapter if someone asks for it. The exemption can come with required safeguards, when appropriate, to make sure the battery—or a product whose battery is not easily removable—won’t be sent to an incinerator, composting facility, or landfill (other than a facility regulated under subtitle C of the Solid Waste Disposal Act (42 U.S.C. 6921 et seq.)).
